Sydney Film Festival Telstra MobileMovies Awards (Promotion)
Terms and Conditions

  1. These terms and conditions of entry (Terms) apply to the Promotion and entry into the Promotion is deemed acceptance of these Terms.

  2. The promoter is Telstra Corporation Limited (ABN 33 051 775 556) of Level 2, 400 George Street, Sydney, NSW 2000 (Promoter).

  3. The Promotion commences at 8:00am Australian Eastern Standard Time (AEST) on 12 May 2008 and ends at 2:00pm AEST on 20 June 2008 (Promotion Period).

    Entry

  4. Entry is open to all Australian residents aged 18 years or over, excluding management, employees and contractors of the Promoter and any agency, firms or companies associated with the Promotion and their immediate families (Eligible Entrants).

  5. To enter and be eligible to win, an Eligible Entrant must, before 12 midnight AEST on 15 June 2008 (Entry Deadline):

    1. visit www.bigpondmovies.com/sff (the Website);

    2. submit an eligible MobileMovie (in accordance with in clause 6 of these Terms) to the Website via their computer; and

    3. complete and submit the Promotion entry form on the Website including providing their name, address, email address and mobile telephone number,

    (collectively an Eligible Entry).

    Eligible MobileMovies

  6. To be eligible a MobileMovie must:

    1. have been filmed on a mobile phone;

    2. be no more than one minute in length;

    3. be no larger than 12MB in size and in either *.avi, *.mov (H264), *.mpg, *.3gp, *.wma (WMA1, 2 or 3) format;

    4. relate to the theme "My Town" (the Theme);

    5. not contain any material that is offensive, defamatory, violent, obscene, in bad taste, threatening, racially, religiously or ethnically discriminatory, homophobic, sexist or illegal;

    6. not contain any material that encourages anyone to do anything illegal or dangerous;

    7. not use someone's image or invade their privacy without their consent;

    8. not breach copyright or other intellectual property rights owned by any party or include anybody else's material, including without limitation any performances, lyrics, sound recordings, musical score or other copyright material, without their consent or licence;

    9. not contain any nudity or other material that could cause the MobileMovie to be classified higher than a PG rating;

    10. not contain any advertising material; and

    11. otherwise comply with these Terms, in particular the warranties given by Eligible Entrants under clause 38 of these Terms.

  7. Eligible Entrants are permitted to edit their MobileMovie using a device other than a mobile phone, such as a computer.

  8. Eligible Entrants may enter as many times as they wish provided that each Eligible Entry consists of a separate and different MobileMovie.

  9. All MobileMovies (forming part of Eligible Entries) will be displayed on the Website until 17 June 2008. Short Listed Movies (as defined in clause 11a. of these Terms) will continue to be displayed on the Website following 17 June 2008 until the Promoter determines.

    Judging

  10. Judging of all MobileMovies (forming part of Eligible Entries) will take place on 16 June 2008 at 400 George Street, Sydney, NSW 2000 and will be conducted by a panel comprising representatives of the Promoter and the Sydney Film Festival Organising Committee (Judging Panel).

  11. The Judging Panel will select:

    1. the 6 MobileMovies (forming part of Eligible Entries) which, in its opinion are the most creative and best reflect the Theme (Short Listed Movies); and

    2. the Eligible Entrant whose MobileMovie (forming part of an Eligible Entry) is, in its opinion, the most creative and best reflects the Theme (Judge's Award Winner).

  12. The Promotion is a game of skill only and chance plays no part in determining the winners.

    Voting

  13. The Short Listed Movies will be available for viewing by the public on the Website.

  14. Between 8:00am AEST on 17 June 2008 and 2:00pm AEST on 20 June 2008 (Voting Period) members of the public may vote for the Short Listed Movie that, in their opinion is the most creative and best reflects the Theme, by submitting a vote on the Website (Vote).

  15. The Eligible Entrant whose Short Listed Movie receives the highest number of Votes during the Voting Period will receive the Promotion's people's choice award (People's Choice Award Winner).

  16. The Promoter may deny Votes for any Short Listed Movie where computer-generated or other viral methods of voting appear to distort or manipulate Votes and where this may affect the integrity of the Voting process.

    Prizes

  17. The Judge's Award Winner will receive:

    1. two return economy airfares from their nearest capital city to Toronto, Canada, all for use between 1 September 2008 and 15 September 2008 on an airline (or airlines) determined by the Promoter, to the maximum value of $9,096 (including GST);

    2. 10 nights accommodation in a standard room at the Westin Bristol Place hotel in Toronto, Canada (excluding meals) valued at $2351.75 (including GST);

    3. 20 single general admission tickets to the Toronto International Film Festival in Toronto, Canada, for use between 4 September 2008 and 13 September 2008, valued at AU$450;

    4. AU $1,000 spending money;

    5. the opportunity to have a meeting with representatives of Porchlight Films Pty Limited for 2 hours of advice about their future film making aspirations, for use within 1 year of the conclusion of the Promotion Period, either in Sydney or via the telephone, on a date and time acceptable to Porchlight Films (Advice Session);

    6. the opportunity a script assessment by Script Central, including an "in depth analysis" of a script submitted by the Judge's Award Winner to Script Central, consisting of general and specific script notes and analysis and a 30 minute telephone script consultation valued a $330 (including GST) for use before 1 July 2009 (Script Assessment);

    7. the opportunity to participate in a Final Cut Pro Fundamentals or Final Cut Pro Intermediate course with Metro Screen Limited located at Paddington Town Hall, Cnr of Oatley Rd + Oxford St, Paddington, NSW, valued at $696 (including GST), for use before 31 December 2008 (Course), subject to Course participation criteria and schedules. The Course includes a VETAB accredited short course and receiving an Apple FCP 5 course manual and a statement of attainment upon successful completion;

    8. a one year associate membership to the Australian Directors Guild (ADG), subject to the ADG's membership criteria and requirements, valued at $150 (including GST), for redemption with the ASDA before 1 July 2009;

    9. a one year associate membership of the Screen Producers Association of Australia (SPAA), subject to SPAA's membership criteria and requirements, valued at $275 (including GST), for redemption within 12 months of the conclusion of the Promotion Period;

    10. one registration to attend the SPAA Fringe 2008 two day forum, valued at $200 (including GST);

    11. a Nokia N95 mobile handset valued at $1199 (including GST) (RRP) (Nokia N95); and

    12. a directors chair valued at $110 (including GST) (RRP) (Directors Chair);

  18. The People's Choice Award Winner will receive:

    1. a Nokia N95; and

    2. a Directors Chair.

  19. An Eligible Entrant can be both the Judge's Award Winner and the People's Choice Award Winner.

  20. Each Eligible Entrant whose MobileMovie is selected as a Short Listed Movie will receive one ticket to attend the Sydney Film Festival Awards Night at the State Theatre, Sydney, NSW 2000 on 21 June 2008 (the Awards Night) valued at $40 (including GST).

  21. The Eligible Entrants whose MobileMovies are selected as Short Listed Movies but who are not selected as the Judge's Award Winner or the People's Choice Award Winner will receive a Directors Chair.

  22. Winners will be announced at the Awards Night and will be published on www.bigpondsmovies.com/sff on 23 June 2008.

  23. Prizes are not transferable or exchangeable and are not redeemable for cash.

  24. All other costs associated with the prizes are the responsibility of the winners including, without limitation all access, connection, call, data and other usage charges associated with the Nokia N95, all travel costs associated with attending the Meeting, Script Assessment, Course and the Awards Night, and all airport transfers, meals and other costs associated with travelling to Canada to attend the Toronto International Film Festival.

  25. If the Promoter is unable to provide any winner with any nominated prize, the Promoter reserves the right to supply an alternative prize of similar monetary value.

  26. If any prize winner chooses not to accept an element of their prize, then they forfeit that element and the Promoter is not obliged to substitute that element or provide its equivalent in cash.

  27. Any prizes or elements of prizes that have not been claimed by 22 December 2008 will be distributed at the Promoter's absolute discretion.

  28. The Promoter takes no responsibility for any variation in the value of prize.

  29. The total maximum prize pool value is $15,901.60.

  30. The Promoter accepts no responsibility for any tax liabilities that may arise from winning any prizes.

    General

  31. All decisions of the Judging Panel and the Promoter's decisions in relation to any aspect of the Promotion, including whether the eligibility criteria have been met or these Terms have been satisfied, are final and binding. No correspondence will be entered into.

  32. The Promoter accepts no responsibility for any entries not received for any reason before the Entry Deadline or otherwise. Entries will be deemed to be accepted at the time of receipt and not at the time of transmission. No responsibility will be taken for lost, late or misdirected entries. The Promoter is not responsible for technical difficulties with the entry mechanism and does not warrant that the entry mechanism will be available at all times.

  33. To the extent permitted by law, the Promoter shall not be liable for any loss or damage whatsoever (including but not limited to direct or consequential loss) or personal injury suffered or sustained in connection with this Promotion. All Eligible Entrants participate in the Promotion at their own risk and agree to indemnify the Promoter for any claims or otherwise made against the promoter in connection with their involvement in this Promotion.

  34. The Promoter reserves the right to disqualify entries in the event of non-compliance with these terms and conditions of entry.

  35. Any Eligible Entrant who, in the opinion of the Promoter, tampers or interferes with the entry mechanism, the judging process or the voting process in any way, or who does not properly comply with the entry process, the judging process or the voting process will be ineligible to win.

    Entrant's Acknowledgements

  36. By entering the competition, entrants understand and agree that the Promoter may use and disclose the information provided by the entrant on the terms and for the purposes (including marketing) set out in the Promoter's Privacy Statement available at www.telstra.com.au/privacy/privacy_statement.html or by calling 1800 039 059. If the entrant would like to access or correct the personal information that the Promoter holds about the entrant, or the entrant does not wish the information to be disclosed, the entrant should advise the promoter by phoning 1800 039 059.

  37. By entering the Promotion, Eligible Entrants:

    1. grant the Promoter a worldwide, perpetual, irrevocable, royalty free licence (including the right to sub-licence) to use, reproduce, modify, re-purpose alter, adapt the Eligible Entrant's MobileMovie and communicate it to the public in any form and in any media (including any media not yet in existence at the time of the Promotion) for any purpose including the Promoter's marketing and promotional purposes; and

    2. unconditionally and irrevocably consent to the Promoter doing or failing to do any act in relation to the Eligible Entrant's MobileMovie that may, except for this paragraph, infringe the Eligible Entrant's moral rights (as defined in Part IX of the Copyright Act 1968 (CTH) in the MobileMovie (Moral Rights);

    3. waive any and all Moral Rights they have in the MobileMovie outside Australia; and

    4. agree not to institute, maintain or support any claim for infringement of their Moral Rights in their MobileMovie.

  38. By entering this Promotion, Eligible Entrants warrant that:

    1. they own or have the right to licence to the Promoter the right to use and communicate to the public (in the manner contemplated by these Terms) all intellectual property rights, including all copyright, contained in the MobileMovie, including without limitation, in the film, any performances, lyrics, sound recordings, musical score or other copyright material;

    2. all persons who have contributed to the creation of the MobileMovie, including without limitation, all person who contributed to making the MobileMovie, who are featured in the MobileMovie (including their images and voices), or who otherwise own intellectual property in the MobileMovie or any material contained in the MobileMovie (including without limitation, any lyrics, musical score, film, sound recordings, any performance or any other copyright material) (Contributors), have consented to:

      1. their contribution;

      2. the Eligible Entrant's MobileMovie being entered in the Promotion; and

      3. the Eligible Entrant's MobileMovie being used by the Promoter as contemplated by these Terms,

      and agree to provide evidence of such consent if requested by the Promoter; and

    3. all Contributors to the Eligible Entrant's MobileMovie have:

      1. unconditionally and irrevocably consented to the Promoter doing or failing to do any act in relation to the MobileMovie that may, except for this paragraph, infringe the Contributor's Moral Rights; and

      2. waived any and all Moral Rights they have in the MobileMovie outside Australia; and

    4. their entry into this Promotion and compliance with these Terms does not breach any existing agreement or arrangement between the. Eligible Entrant and any other person or infringe the rights (including intellectual property rights) of any third party.

  39. By entering the Promotion, Eligible Entrants agree and acknowledge that:

    1. they may be contacted by the Promoter (or its agent) to provide comments about the Promotion and the Promoter (or its agent) may take photos of the Eligible Entrant (collectively, the Materials), and the Eligible Entrant will cooperate in good faith with such requests;

    2. the Promoter may use, reproduce, modify, alter, adapt the Materials and communicate them to the public anywhere, in any form and in any media (including any media not yet in existence at the time of the Promotion) for any purpose including the Promoter's marketing and promotional purposes without compensation or reference to the Eligible Entrant. The Promoter may license, authorise or otherwise transfer the rights in the Material to other to do the same;

    3. they do not own any right, title or interest, including any intellectual property rights, in the Materials and that the Promoter owns all such right, title and interest, in the Materials. By entering the Promotion the Eligible Entrant assigns absolutely any right, title and interest, including intellectual property rights, that they have in the Materials to the Promoter so that all such right, title and interest throughout the world vests automatically in the Promoter on their creation;

    4. they unconditionally and irrevocably consent to the Promoter doing or failing to do any act in relation to the Materials that may, except for this paragraph, infringe their Moral Rights;

    5. waived any and all Moral Rights they have in the Materials outside Australia; and

    6. agree not to institute, maintain or support any claim for infringement of their Moral Rights in the Materials.
